Filing 9 TEXT ORDER: This matter comes before the Court upon Defendant's Motion to Compel Arbitration and to Dismiss Plaintiff's Amended Complaint. (ECF No. #7 .) This Court's individual preferences state that, "[i]n an effort to resolve cases expeditiously, before bringing a motion to dismiss,... a party must submit a letter, not to exceed three (3) single-spaced pages, requesting a pre-motion conference.... Within seven (7) days after receipt of this letter, all adversaries must submit a written response, not to exceed three (3) single-spaced pages." In order to facilitate this exchange, the Court will construe Defendant's Motion to Dismiss as a request for a pre-motion conference in accordance with the Court's individual preferences, which may be found at #Judge Castner's Preferences. On or before September 25, 2024, Plaintiff shall file a letter, not exceeding three (3) single-spaced pages, responding to Defendant's arguments and advising whether Plaintiff intends to file an Amended Complaint. After reviewing Plaintiff's letter, the Court will either schedule a pre-motion conference or reopen the motion and set a briefing schedule.
