OPINION AND ORDER dated 7/13/11 that defendant's motion for summary judgment with respect to plaintiff's due process claim is granted. With the dismissal of that claim, the only viable claims remaining in this action arise under New York law. Because the court no longer has subject matter jurisdiction over this case, the court remands it to state court for further proceedings. ( Ordered by Senior Judge Allyne R.
