Accordingly, it directs the Commissioner to release $57,212.74 of past-due benefits withheld to plaintiffs counsel and any remaining balance to plaintiff. September 26, 2011	Filing 24 MEMORANDUM & ORDER: The Commissioners motion is denied and the case is remanded for further proceedings. On remand, the ALJ should properly apply the treating physician rule, and then proceed to assess claimants credibility in light of the newly deve loped record and the evidence as a whole. See attached memorandum and order for details. The Clerk of the Court shall remand this case back to the Commissioner of social security. There will be no written decision mailed to counsel.
