Filing 56 MEMORANDUM DECISION AND ORDER dated 12/20/16 granting defendant's 32 Motion for summary judgment. Filing 6 ORDER: For the reasons set forth in the attached order, the claims in Mr. Thomas's amended complaint 5 are dismissed against the City of New York, the Department of Education, the Administration for Children Services, the New York City Police Department, Kier McAuly, and Micheal Cardozo. The Clerk is directed to amend the caption accordingly. The claims shall proceed against Gina Digglio, Cathy Chiou, Charmaine Cort, V. Grant, and the two John Doe police officers. The Clerk is directed to issue summons against those defendants, and the U.S. Marshal Service is directed to effect service of process without prepayment of fees. The Clerk shall mail a courtesy copy of the same papers to the Corporation Counsel for the City of New York, Special Federal Litigation Division. The case is respectfully referred to Judge Cheryl Pollak for pretrial supervision, including identification of the Doe defendants. Ordered by Judge John Gleeson on 12/22/2015. (Hossain, Samia) |
