ORDER granting 128 Motion for Settlement; ORDER DISMISSING CASE. The Court finds that the settlement was the result of contested litigation and arm's-length negotiation, and that the settlement terms are fair and appropriate. Class Members were provided the best notice practicable under the circumstances. The Court further finds that the Notice and distribution of such Notice comported with all constitutional requirements, including those of due process. The Court finds that the amount of fees requested is fair and reasonable. The entire case is dismissed on the merits and with prejudice, with each side to bear its own attorneys' fees and costs except as set forth in the Settlement Agreement. See attached. ORDER: For the reasons stated in the attached memorandum and order, plaintiffs' motion for partial summary judgment at 86 is granted in part and denied in part. Plaintiff Flores is entitled to summary judgment on his overtime and wage statement claims against defendants MCSS Rest. Corp. and Michael Siderakis.
