Filing 5 MEMORANDUM and ORDER: The Petitioner's application to proceed in forma pauperis is granted #2 . Plaintiff is granted thirty (30) days leave to file an amended complaint. See Cruz v. Gomez, 202 F.3d 593, 597 (2d Cir. 2000). Plaintiff's complaint, filed in forma pauperis , is dismissed against the City of New York, for failure to state a claim upon which relief may be granted. See 28 U.S.C. 1915A. Plaintiff is granted thirty (30) days leave from the date of this memorandum and order to file an amended complaint as detailed above. Any amended complaint that Plaintiff elects to file will be reviewed for sufficiency. The Court certifies pursuant to 28 U.S.C. l915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. Coppedge v.
