ORDER granting #5 Defendants' Motion to Remand to State Court. After filing a notice of removal on the basis of diversity of citizenship, (28 U.S.C. 1332, 1441), Defendants now move to remand the action back to state court. Defendants assert that the original understanding of where one defendant-entity was incorporated was incorrect. Defendants now assert that there is not complete diversity of citizenship in this action, and that there is no subject matter jurisdiction. Accordingly, the motion to remand the action to state court is granted. See 28 U.S.C. 1447 (If at any time before final judgment it appears that the district court lacks subject matter jurisdiction, the case shall be remanded.).
