Fact discovery must be completed by April 12, 2021. Plaintiff's medical expert disclosures are due by April 30, 2021. Defendants' medical expert disclosures are due by May 10, 2021. December 21, 2020 Opinion or Order ORDER TO SHOW CAUSE: As discussed during the course of today's initial conference, this case was commenced in state court, by summons with notice, on June 18, 2019, followed by a verified complaint filed on or about September 23, 2019. The action was removed to this Court, on the basis of diversity jurisdiction, on November 23, 2020 - well outside the narrow exception to the one-year limit on removing diversity cases from state court. See 28 U.S.C. 1446(c)(1). The law is clear that defendants bear the burden of demonstrating the propriety of removal, see, e.g., O'Donnell v. AXA Equitable Life Ins. Co., 887 F.3d 124, 128 (2d Cir. 2018), and the removal statute is strictly construed against removal and in favor of remand[,] Ofori v. BJ's Wholesale Club, Inc., No. 18-CV-5940 (ENV) (SMG), 2019 WL 1785529, at *2 (E.D.N.Y. Mar. 7, 2019), adopted, 2019 WL 1748598 (E.D.N.Y. Apr. 18, 2019). In this case, it appears doubtful that defendants will be able to establish, by clear and convincing evidence, that plaintiff's delay in responding to the discovery demands concerning plaintiff's damages was the product of bad faith and a specific desire to prevent removal. See, e.g., Khakimova v. Acme Mkts., Inc. , 20-CV-02734 (ARR) (PK), 2020 WL 5511537, at *2-4 (E.D.N.Y. Sept. 14, 2020); Marin v. Sephora USA, Inc., No. 20 Civ. 3520 (CM), 2020 WL 3999711, at *5-7 (S.D.N.Y. July 15, 2020); Martinez v. Yordy, 16 Civ. 005 (BMC), 2016 WL 8711443, at *2-4 (E.D.N.Y. Feb. 19, 2016). Accordingly, defendants are directed to show cause, via ECF, by January 8, 2021, why the case should not be remanded to state court. Ordered by Magistrate Judge Roanne L. Mann on 12/21/2020. (GM)
