Filing 10 Letter in Response to 4/3/23 Order by Target Corporation (Crowley, Michael) |
Filing 9 ORDER TO SHOW CAUSE: Defendant removed plaintiff's personal injury case from Queens County Supreme Court on March 21, 2023, invoking the Court's diversity jurisdiction under 28 U.S.C. 1332. ECF No. #1 . Defendant's counsel does not provide any document or writing that establishes that the amount in controversy exceeds $75,000. Defendant asserts that removal is proper because of the nature of injuries alleged in plaintiff's bill of particulars and because plaintiff alleges "special damages for medical expenses amounting to approximately $37,500." Plaintiff's bill of particulars is insufficient to establish the amount in controversy required for removal. Accordingly, for the reasons stated in the attached Order, defendant is hereby ordered to show good cause by April 17, 2023 why this matter should not be remanded to state court for lack of subject matter jurisdiction. See attached Order. Ordered by Magistrate Judge Lois Bloom on 4/3/2023. (VP) |
