August 21, 2020 Opinion or Order ORDER granting #6 Motion for Leave to Proceed in forma pauperis. Upon review of the in forma pauperis application, the Court finds that plaintiff's financial status qualifies plaintiff to commence this action without prepayment of the filling fee. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's application to proceed in forma pauperis is granted. Counsel is directed to serve the complaint on defendant. Defendant shall serve the administrative record on plaintiff by November 19, 2020, but shall not file the record on ECF until the motion is fully briefed. Defendant shall serve a motion by January 19, 2021; Plaintiff shall serve a response to Defendant's motion, and any cross-motion, by March 22, 2021; and Defendant shall serve its reply and file the fully briefed motion, including the administrative transcript, on ECF, by April 12, 2021. Counsel is advised that on March 2, 2020, the Commissioner of Social Security filed a notice in the Federal Register setting forth the names and current addresses for service of process on the Commissioner in disability cases for each United States District Court. See https://www.federalregister.gov/documents/2020/03/02/2020-04246/notice-announcing-addresses-for-service-of-process. The Notice announced that service of process for the Eastern District of New York was directed to be made upon the Regional Chief Counsel's Office in Kansas City, Missouri. Ordered by Judge Joan M. August 10, 2020 Opinion or Order Filing 5 ORDER: For the reasons that follow (PLEASE SEE ORDER FOR FURTHER DETAILS), Plaintiff's application to proceed in forma pauperis is denied without prejudice and with leave to renew upon filing the Long Form within twenty (20) days from the date of this Order. Alternatively, plaintiff may remit the $400.00 filing fee. Plaintiff is cautioned that a failure to timely comply with this Order will lead to the dismissal of the complaint without prejudice. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
