| Filing 4 NOTICE of Voluntary Dismissal by Albert Hernandez as to Defendant Carco Group, Inc. d/b/a Driver IQ (Singer, Adam) |
ORDER TO SHOW CAUSE. To assist the Court in its review of standing in this action, which appears to involve false information on Plaintiff's credit report, Plaintiff is directed to respond via letter filed on ECF by close of business on September 6, 2023, as follows: 1. Does Plaintiff claim any concrete, particularized injury in fact from the statutory violations alleged herein? If so, please set forth such injury/injuries with particularity. Note that the conclusory, theoretical allegations of "actual harm" in the complaint fail to sufficiently identify such harm. 2. If Plaintiff is not claiming any such concrete injury, in light of the Supreme Court's decision in TransUnion LLC v. Ramirez, 141 S. Ct. 2190, 210 L. Ed. 2d 568 (2021), counsel shall provide any authority or basis for Plaintiff to assert standing in this action, or indicate whether the action should be dismissed. Plaintiff shall provide a copy of this order to counsel for Defendants. Defendants shall file any response thereto with one week of the filing by Plaintiff. Any response by Plaintiff's counsel shall set forth whether Defendants have and/or will correct the disputed item on Plaintiff's credit report. Ordered by Judge Gary R. Brown on 8/30/2023. (JP)
