Text Only Order - On September 13, 2012, plaintiffs filed a letter brief seeking to postpone adjudication of defendants' Bill of Costs until after the Second Circuit renders a decision on their pending appeal. (See Dkt. No. 356.) That request is denied. The court intends to consider all post-trial claims, including motions for attorneys' fees, should there be any, in accordance with its residual jurisdiction over collateral matters. See Tancredi v. Filing 214 ORDER: IT IS HEREBY ORDERED that: (1) As to the supplemental report of plaintiffs' expert witness, Mr. Parnell: (a) the Court finds that the supplemental report contains a methodology and analysis regarding an odds ratio which was not contained in the witness's original report, that methodology and analysis are not based on any data which came into existence after the original report and, therefore, that portion of the supplemental report regarding the odds ratio is STRICKEN; and (b) plaintiffs' expert added ACS data in the supplemental report to which defendants object, but it appearing that such data and its reliability did not become fully available until after the service of the original expert report, the inclusion of such data and analysis thereof in the supplemental report is proper and defendants' request for an order striking that portion of the supplemental expert witness report of plaintiffs is DENIED; and (2) As to defendants' supplemental expert witness report of Mr. Salzberg: (a) it appearing to the Court that the findings and conclusions set forth in the supplemental report at sections III(1), (2), (3) and (5) were not contained in the original report, they are not based on any new data which came into existence after the original report, these analysis and conclusions were reasonably available at the time of the original report and, therefore, plaintiffs' request to strike the conclusions and findings at III(1), (2), (3) and (5) is GRANTED and those conclusions and findings are STRICKEN from defendants' supplemental expert witness report; (b) plaintiffs' motion to strike the testimony of Mr. Salzberg on the ground that he does not adopt the original expert witness report by Mr. Fairley is DENIED; and (c) it appearing that Table A in the supplemental report is not based on any new data which came into existence after the original expert witness report, plaintiffs' motion to strike that table from the supplemental report is GRANTED and Table A in the supplemental report is STRICKEN.
