MEMORANDUM-DECISION AND ORDER: GRANTING in part and DENYING in part the # 36 Motion for Summary Judgment; and GRANTING in part and DENYING in part the # 38 Motion for Summary Judgment. Further ORDERED that Plaintiff is to inform the Court in writ ing within 10 days of this MDO whether he has complied with New York General Municipal Law's Notice of Claim requirement with regard to his state-law claims; and if so, file a copy of that Notice of Claim. If Plaintiff fails to timely file the n ecessary documents to demonstrate compliance with the Notice of Claim requirement the Court will dismiss the remaining pendent state-law claims. Plaintiff's counsel is ORDERED to initiate a telephone conference, using a professional telephone conferencing service, with the Court and opposing counsel on Tuesday, 4/12/2011, at 9:45 a.m., to set a trial date.
