MEMORANDUM DECISION AND ORDER: It is ORDERED that Avomex's # 14 motion for dismissal based upon lack of personal jurisdiction is DENIED; AMS' # 10 motion for an order dismissing Plaintiff's complaint pursuant to FRCP 12(b)(6) is DE NIED; Defendants' # 10 and # 14 motions for an order dismissing Plaintiff's complaint for improper venue are DENIED; Defendants' # 10 and # 14 motions for a transfer of venue are GRANTED; the Clerk of this Court shall transfer this action to the U. S. District Court for the Northern District of Texas; the Court hereby waives the 10 day waiting period provided for in L. R. 83.6; and it is further ORDERED that Plaintiff's # 16 cross motion to amend the complaint is DENIED as moot. Signed by Chief Judge Norman A. Mordue on 1/14/2010. (mae)
