TEXT ONLY ORDER (from case 1:09-cv-684) - Presently before the court is: (1) Jeffrey Burfeindt's 8 MOTION for Reconsideration of the court's summary order remanding this action to state court (Dkt. No. 4); and (2) Burfeindt's newly filed complaint in the action (Dkt. No. 9). The motion for reconsideration objects to the summary remand order because it was issued before the Clerk of the Court had docketed Burfeindt's amended notice of removal. However, this issue was addressed sua sponte in the court's July 27, 2009 text order. The court reiterates for the third time that Burfeindt cannot remove a state criminal action by invoking the court's original jurisdiction under 28 U.S.C. 1331. As such, the mtoion for reconsideration is denied. As for Burfeindt's newly filed complaint, the court notes that this action has been closed. As such, the Clerk of the Court is directed to assign Burfeindt's complaint (Dkt. No. 9) a new case number. Within (30) thirty days of the issuance of this order Burfeindt shall either pay the filing fee for the new action or submit an application to proceed in forma pauperis. Failure to do so will result in dismissal of Burfeindt's action without further order of the court. The Clerk of the Court is directed to mail a copy of this text order to all non CM/ECF parties.
