Filing 85 JUDGMENT DISMISSING ACTION BY REASON OF SETTLEMENT: this action is DISMISSED in its entirety without prejudice to the right of the parties to secure reinstatement of the case within thirty (30) days after the date of this judgment by making a showing that the settlement was not, in fact, consummated; and in the event that no request is made for reinstatement within thirty (30) days of the date of this judgment, the dismissal of this case shall thereafter be with prejudice. Filing 75 MEMORANDUM-DECISION & ORDER granting in part and denying in part # 58 Defendant DOH's Motion for Judgment on the Pleadings; and granting in part and denying in part # 65 Plaintiff's Motion to Amend their Second Amended Complaint. It is o rdered that Plaintiff's NYHRL claims against Defendant DOH are dismissed. The following claims survive: Plaintiff Martel's hostile-work environment claim against Defendant Magin; Plaintiff Pimentel's quid pro quo claim against Defendant Magin for acts occurring after 5/25/07; Plaintiff Pimentel's hostile-work environment against Defendant Magin; and Plaintiff Pimentel's Title VII claims against DOH. Plaintiff is ordered to file a revised signed Third Amended Complaint within seven days from the date of this Decision that omits the claims dismissed and asserts only the claims permitted by this Decision & Order.
