August 13, 2013 Opinion or Order Filing 75 MEMORANDUM-DECISION & ORDER granting in part and denying in part # 58 Defendant DOH's Motion for Judgment on the Pleadings; and granting in part and denying in part # 65 Plaintiff's Motion to Amend their Second Amended Complaint. It is o rdered that Plaintiff's NYHRL claims against Defendant DOH are dismissed. The following claims survive: Plaintiff Martel's hostile-work environment claim against Defendant Magin; Plaintiff Pimentel's quid pro quo claim against Defendant Magin for acts occurring after 5/25/07; Plaintiff Pimentel's hostile-work environment against Defendant Magin; and Plaintiff Pimentel's Title VII claims against DOH. Plaintiff is ordered to file a revised signed Third Amended Complaint within seven days from the date of this Decision that omits the claims dismissed and asserts only the claims permitted by this Decision & Order.
