Filing 24 MEMORANDUM-DECISION ORDER denying 21 Motion to Dismiss for Lack of Prosecution: The Court hereby ORDERS that Defendants' motion to dismiss for failure to prosecute and/or comply with discovery is DENIED; and the Court further ORDERS that Plai ntiff shall have twenty (20) days from the date of this Memorandum-Decision and Order to submit to a deposition; and the Court furtherORDERS that if Plaintiff fails to submit to a deposition within twenty (20) days from the date of this Memorandum-De cision and Order, and upon Defendants notifying the Court that Plaintiff has failed to comply with the terms of this Memorandum-Decision and Order, the Court shall issue an order dismissing this action with prejudice; and the Court further ORDERS that the Clerk of the Court shall serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
