No. 31) is GRANTED IN PART AND DENIED IN PART; it is further ORDERED, that defendants motion for summary judgment and dismissal of plaintiffs first cause of action for FMLA interference is GRANTED; it is further ORDERED, that defendants motion for summary judgment and dismissal of plaintiffs second cause of action for FMLA retaliation is GRANTED; it is further ORDERED, that defendants motion for summary judgment and dismissal of plaintiffs third cause of action for disparate treatment in violation of Title VII is GRANTED; it is furtherORDERED, that defendants motion for summary judgment and dismissal of plaintiffs fourth cause of action for a hostile work environment in violation of Title VII is DENIED; it is further ORDERED, that defendants motion for summary judgment and dismissal of pla intiffs fifth cause of action for retaliation in violation of Title VII is DENIED; it is further ORDERED that a Settlement Conference is scheduled in this matter for Wednesday, June 26, 2013 at 10:00 a.m. in Albany. The parties are directed to appear at that time and make submissions in advance of the conference as directed in this Court's Order Setting Settlement Conference which will be forthcoming.
