It is hereby ORDERED that Empire's 17 Motion for Leave to file an amended answer to assert a claim for indemnification against the City is GRANTED and Empire shall file such amended answer on or before 5/27/2011 and a jury trial is GRANTED; and the City's cross-motion for leave to file an amended answer to assert a cross-claim for indemnification against Empire (Dkt Nos. 20 , 21 ) is GRANTED and the City shall file such amended answer on or before 5/27/2011.
