Filing 9 DECISION AND ORDER: DENYING plaintiff's # 5 Motion for a Temporary Restraining Order and RESERVING on plaintiffs # 5 Motion for a Preliminary Injunction. Further ORDERED that plaintiff shall serve defendants with a copy of the Summons and Co mplaint, this Order, and a copy of any motion papers not previously served upon defendants, via overnight mail or overnight delivery on or before 5:00 PM on 10/15/2011, and promptly thereafter electronically file a Certificate of Service with the Cou rt. Plaintiff shall also serve defendants with a copy of the Summons and Complaint pursuant to Rule 4 of the FedRCivP and file a Certificate of Service. Response papers to plaintiffs motion for a preliminary injunction, if any, are to be electronica lly filed and served by 10/20/2011; plaintiff's reply shall be electronically filed by 10/24/2011. Further ORDERED that the attorneys are directed to file any witness list and exhibit list by 10/25/2011. Exhibits must be pre-marked as specified herein. A complete set of marked exhibits should be brought on the day of the hearing for the Judge and for opposing counsel. The hearing on plaintiff's Motion for a Preliminary Injunction is scheduled for 9:30 AM on 10/27/2011, in Courtroom # 4 of the Federal Building, Syracuse, New York, before District Judge Glenn T.
