Filing 25 DECISION & ORDER: It is ordered that the # granting in part and denying in part 14 Motion for Contempt is DENIED and the # 14 Motion for Sanctions is GRANTED in the form of recovery of costs and attorney's fees associated with the preparatio n, filing and argument of the contempt motion. Within 14 days of this order, the petitioner shall submit to the court, in affidavit form with the required supporting documents necessary to comply with the governing caselaw of this circuit, quantifica tion of the costs and attorney's fees necessitated by respondent's actions. Within 14 days from the date of the application, the respondent may submit opposition to the request, limited to addressing the amount sought and not the award of sanctions itself. Filing 10 ORDER: The court rules Granting the # 1 Motion to Compel; Respondent Barbara Bouchey shall appear for a deposition on 8/30/2011 at 9:00 AM, not to exceed four hours in duration, at the offices of O'Connell and Aronowitz in Albany, New York and shall produce all documents within her possession, custody and control referenced in Exhibit A to the subpoena issued to respondent Bouchey, Respondent Sheila Cote shall appear for a deposition on 8/31/2011 at 9:00 AM, not to exceed four hours in du ration, at the offices of O'Connell and Aronowitz in Albany, New York and shall produce all documents within her possession, custody and control referenced in Exhibit A to the subpoena issued to respondent Cote, the depositions shall proceed in accordance with this court's standing guidelines regarding depositions which are attached collectively as Appendix A and made a part of this order; The court further rules Denying the # 4 Motion to Quash; and Denying the # 6 Motion to Quash. No costs or attorneys' fees are awarded to any party in connection with the pending motion. The Clerk is directed to promptly forward copies of this order to counsel for NXIVM Corporation, who is directed in turn to serve copies of the order up on Susan Faye Dones and Kim Marie Woolhouse, the defendants in the underlying adversary proceeding, by mail. In addition, the clerk is directed to foward a copy of this order, by mail, to the two named respondents in this matter. Signed by Magistrate Judge David E.
