Filing 26 DECISION AND ORDER granting Defts' 12 Motion to Dismiss for Failure to State a Claim. All claims against Deft Dean Rowe are dismissed with prejudice. All claims against Hudson New York Police Department are dismisssed. Pltf is entitled to r e-plead these claims against proper party by filing a new complaint by 12/7/12. If Pltf fails to do so, Clerk of Court will close this file. If Pltf files a new complaint, it will supersede the now dismissed complaint and he cannot incorporate by reference any allegations contained in the now dismissed complaint.
