DECISION AND ORDER granting in part and denying in part # 56 Defendant's Motion for Summary Judgment as set forth in Part IV of this Decision and Order such that SURVIVING Defendant's motion are Plaintiff's claims for negligent misre presentation and/or advice. Counsel are directed to appear on 10/28/15 at 11:00 a.m. in chambers for a pretrial conference, at which counsel are directed to appear with settlement authority, and in the event that the case does not settle, trial will be scheduled at that time. Plaintiff is further directed to forward a written settlement demand to defendants no later than 10/9/15, and the parties are directed to engage in meaningful settlement negotiations prior to the conference.
