The Coxsackie-Athens Central School District and Randall Squier's # 15 Motion to Dismiss is GRANTED, and all claims asserted against them are DISMISSED. The New York State defendants' # 16 Motion to Dismiss is GRANTED in part and DENIED in part. All claims asserted against the New York State Department of Education are DISMISSED. Any Fifth Amendment claim is DISMISSED. The substantive due process claim is DISMISSED. The Clerk of the Court is directed to add Carmen Farina, Chancellor of the New York State Department of Educati on, as a defendant, in her official capacity only. The two remaining defendants include Anne M. Zugalla, in her individual capacity for monetary damages only and Carmen Farina, in her official capacity for prospective injunctive relief only, and the Clerk of the Court is directed to amend the caption accordingly. The two remaining claims are the procedural due process and stigma-plus claims. The remaining defendants shall file an answer to the complaint on or before June 23, 2014. Signed by Judge David N.
