Filing 16 DECISION AND ORDER. Defendants' 3 motion to dismiss the Fourth and Fifth Causes of Action in the Complaint is GRANTED, and these causes of action are DISMISSED as set forth herein. Plaintiff's 9 motion to amend the complaint is GRANTE D IN PART AND DENIED IN PART. The motion is granted isasmuch as Plaintiff may file an amended complaint adding a demand for punitive damages to the WHEREFORE clause, and the motion is denied in all other respects.
