The motion to dismiss filed by the City of Hudson, Gary Graziano, Ellis Richardson, and Edward Moore 18 , is GRANTED in part and DENIED in part; the motion to dismiss filed by Randy Clark 20 is GRANTED in part and DENIED in part; the motion to dismiss filed by Nicholas M. Pierro, Officer Row, Keyser and Kevin Sweet 22 is GRANTED in part and DENIED in part; plaintiff Jermaine Mcrae's cross-motion to amend 26 is GRANTED. The Clerk of the Court is directed to file the Amended Complaint [26-2] as the operative pleading; all claims asserted against defendants City of Hudson and Ellis Richardson are DISMISSED, and the Clerk is directed to remove those two defendants from the caption.
