No. 22) is GRANTED; and it is further ORDERED, that Donavans property damage claims are DISMISSED with leave to amend for failure to state a claim upon which relief may be grant ed; and it is further ORDERED, that if Donavan wishes to amend his Complaint to allege claims for property damage, he must file a signed amended complaint that cures the pleading defects identified above in this Memorandum-Decision and Order within thirty (30) days from its filing date (by 10/04/17).
