Filing 84 ORDER granting in part and denying in part Defendants' 62 Motion for Summary Judgment. All claims from the Complaint (Dkt. No. 1 ) are DISMISSED with prejudice with the exception of the Title VII retaliation claim against OCFS, the § 1983 Equal Protection retaliation claim against the Individual Defendants, and the NYSHRL retaliation claim against the Individual Defendants, which may proceed to trial only insofar as they are based on the iPad, time sheet, razor, and EpiPen investigations, the 2015 and 2016 performance evaluations, and the unit inspection and excessive scrutiny. Filing 43 ORDER that the Defts' request for a further deposition of the Pltf, as well as their request for production of additional mental health records (Dkt. No. 40), is denied. Pltf having limited his claim to only garden-variety emotional trauma, the se records are no longer relevant, and therefore a further deposition of the Pltf is unwarranted. Pursuant to Fed R. Civ.
