DECISION AND ORDER granting in part and denying in part # 12 County Defendant's Motion to Dismiss Plaintiff's Amended Complaint; granting # 29 County Defendants' motion to dismiss City Defendants' cross-claims and City Defendan t's cross-claims are dismissed; and granting in part and denying in part # 40 City Defendants' Motion to Dismiss Plaintiff's Amended Complaint. The following claims survive: Plaintiff's malicious prosecution claim against all de fendants; and Plaintiff's claim for conspiracy against all defendants to the extent it contemplates an agreement to maliciously prosecute Plaintiff. All of Plaintiff's remaining claims are dismissed. Defendants are directed to file an answe r to Plaintiff's # 31 Amended Complaint within 14 days of the date of this Decision and Order pursuant to Fed.R.Civ.P. Rule 12(a)(4)(a), and this case is referred back to Magistrate Judge Stewart for the setting of pretrial scheduling deadlines. Signed by Chief Judge Glenn T. Suddaby on 3/22/18. (lmw)
