Filing 29 MEMORANDUM-DECISION AND ORDER granting 18 Motion for Preliminary Injunction; denying 24 Motion to Dismiss for Lack of Subject Matter Jurisdiction: The Court hereby ORDERS that Defendants' motion to dismiss (Dkt. No. 24) is DENIED; and the Court further ORDERS that Plaintiff's motion for a preliminary injunction (Dkt. No. 18) is GRANTED as set forth herein, and Defendants are preliminarily enjoined from enforcing the stream disturbance permit and the freshwater wetlands permit a gainst Millennium in order to prevent Millennium from beginning construction on the Pipeline Project; and the Court further ORDERS that the Clerk of the Court serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
