ORDERED, that plaintiffs motion for leave to proceed IFP is GRANTED (dkt. nos. 9-10) for purposes of filing; and it is further ORDERED, that plaintiffs request for the U.S. Marshals to serve the summons and complaint on defendants and to change his request to one for a trial by court (dkt. no. 8) is DENIED as moot, with leave to replead should the complaint proceed; and it is RECOMMENDED, that plaintiffs complaint be DISMISSED without prejudice and with opportunity to amend should plaintiff be able to overcome the Heck bar by demonstrating that all criminal charges and/or convictions resulting from his arrest on January 13,2018, have been dismissed/vacated by a Court of law; and it is further RECOMMENDED, that all claims against Judge Jennifer G. Sober be DISMISSED without prejudice should plaintiff be able to overcome a claim of judicial immunity and the Heck bar; and it is RECOMMENDED, that if the District Judge adopts this Report-Recommendation & Order, plaintiff be provided thirty (30) days from the date of that Order to file an amended complaint as to any claims dismissed without prejudice, and if plaintiff fails to file an amended complaint within that time frame, the complaint be dismissed without further order of the Court; ORDERED, that the Clerk of the Court serve this Report-Recommendation & Order on plaintiff in accordance with local rules.
