Filing 260 TEXT ORDER: Defendant Steven Erby's Dkt. 258 pro se motion for reconsideration is DENIED. Erby is counselled, and as he was warned by this Court's Dkt. 256 text order, his retention of counsel forfeits his ability to file motions pro se. In any case, his motion is meritless. First, it is unclear what decision he requests the Court to reconsider. Erby's Dkt. 248 motion to remove the receiver seems to be the best fit, but that motion has not yet been decided and thus cannot be reconsidered. Second, even if his motion were procedurally proper, it is without merit. The Court cannot compel KeyBank to accept a settlement, especially one for less than the $6.1 million their complaint demands. Erby's citation to 12 C.F.R. 1026.36 is similarly unavailing because that regulation governs mortgages, not secured loans like those at issue in this case. Though the Court is not unsympathetic to the difficulties this case poses, permitting defendant Erbys counsel to withdraw would profoundly disrupt an already constantly disruptive case. Filing 161 TEXT ORDER: Because of their "extremely broad discretion" in supervising equity receiverships, District Courts may use summary proceedings to avoid formalities that would slow the resolution of disputes. FDIC v. Bernstein, 786 F. Supp. 170, 177 (E.D.N.Y. 1992). An equity receiver has his choice of whether or not to adopt executory contracts that are "not clearly advantageous" to the receivership. See Samuels v. E.F. Drew & Co., 292 F. 734, 737 (2d Cir. 1923); see Resolution Tr. Corp. v. CedarMinn Bldg. Ltd. P'ship, 956 F.2d 1446, 1453 (8th Cir. 1992) ("It has been recognized for at least a century that receivers may repudiate contracts and leases."). Collective bargaining agreements are executory contracts. NLRB v. Bildisco and Bildisco, 465 U.S. 513, 522 (1984). In light of the foregoing, Receiver Daniel Scouler was entitled to decline to adopt the collective bargaining agreement with the International Brotherhood of Electrical Workers because doing so would disadvantage his efforts to efficiently wind down the receivership properties.
