Filing 8 TEXT ORDER terminating #5 Report-Recommendation and Order as moot. Plaintiff's commenced this action, pro se, on September 4, 2020, alleging that Defendants discriminated against him in violation of Title VII. See Dkt. No. 1. In a Report-Recommendation and Order dated September 30, 2020, Magistrate Judge Stewart conducted an initial review of the complaint and recommended that the claim against Defendant Capital Cardiology be dismissed without prejudice, but that the claim against Defendant Kelly be dismissed with prejudice. See Dkt. No. 5. The Report-Recommendation and Order further recommended that the Court grant Plaintiff leave to amend his complaint as against Defendant Capital Cardiology. See id. On October 9, 2020, before the Court could act on the pending Report-Recommendation and Order, Plaintiff filed an amended complaint as of right. In light of Plaintiff having filed an amended complaint, the Court terminates as moot the pending Report-Recommendation and Order and refers the amended complaint to Magistrate Judge Stewart for an initial review.
