Filing 8 TEXT ORDER: On April 8, 2022, the Court issued an Order directing administrative closure of this case due to Plaintiff's failure to comply with the filing fee requirement. Dkt. No. #5 ("Order"). "A party commencing an action... must pay to the Clerk the statutory filing fee." L.R. 5.1.2(a). A civil action is commenced in federal district court by filing a complaint. See Fed. R. Civ. P. 3. The total cost for filing a civil action in this Court is $402.00, consisting of a civil filing fee of $350.00, see 28 U.S.C. 1914(a), and an administrative fee of $52.00. If a party is unable to pay the filing fee for commencing an action, the party may seek to proceed in forma pauperis ("IFP") by submitting an IFP Application Form, in accordance with the requirements set forth by 28 U.S.C. 1915 and the Local Rules, particularly L.R. 5.1.4. As indicated in the Court's Order, Plaintiff has sought to commence an action by filing a complaint in the Northern District of New York, but has not paid the filing fee, nor has Plaintiff filed an IFP Application Form. Order at 1. Neither Plaintiff's May 3, 2022, filing, Dk. No. #6 , nor Plaintiff's May 5, 2022, filing, Dkt. No. #7 , can be construed as an application to proceed IFP. "Failure to pay the full filing fee or include a signed Application to Proceed In Forma Pauperis will result in the Clerk... referring the case to the assigned judicial officer for an order administratively closing the case." L.R. 5.1.2(a) (emphasis removed). Therefore, Plaintiff's case remains administratively closed, in accordance with the Court's Order, and will remain administratively closed unless Plaintiff pays the required filing fee or submits an IFP Application Form.
