Filing 8 TEXT ORDER: The Court has received Plaintiff's objections, Dkt. No. #7 ("Objections"), to the report and recommendation filed by the Honorable Daniel J. Stewart, Magistrate Judge, Dkt. No. #5 ("Report and Recommendation"). Plaintiff has also filed an amended complaint. Dkt. No. #6 ("Amended Complaint"). The Clerk filed Judge Stewart's Report and Recommendation on February 20, 2024; the Court received Plaintiff's Amended Complaint on February 28, 2024; and the Court received Plaintiff's Objections on March 4, 2024. Because Plaintiff may not have received Judge Stewart's Report and Recommendation before mailing his Amended Complaint, and because Plaintiff may want to consider Judge Stewart's recommendations in amending his complaint, the Court will construe Plaintiff's Objections as a request for this Court to review Judge Stewart's Report and Recommendation instead of accepting his Amended Complaint as a new operative pleading. This means that Plaintiff's original complaint, Dkt. No. #1 , will remain the operative pleading. Once the Court has reviewed the Report and Recommendation, Plaintiff will be permitted to file a new amended complaint to the extent that his original claims are not dismissed with prejudice.
