Filing 74 MEMORANDUM DECISION AND ORDER: GRANTING Defendant's 57 Motion for Summary Judgment with respect to Plaintiff's PMPA claim. Defendant shall advise the court within ten days of the date of this Order and opposing counsel in writing whether it intends to proceed with its breach-of-contract counterclaim. If Defendant advises the Court and opposing counsel, the Court will schedule a telephone conference with the parties to set a trial date for this matter. If Defendant advises the Court a nd opposing counsel that it does not intend to proceed, the Court shall dismiss that counterclaim based on Defendant's representation and the Clerk shall enter judgment in favor of Defendant w/respect to Plaintiff's claims and close this case.
