Azar, Esq. for the Defendant's; the Court held a telephone conference with the parties with the goal to get this matter on track regarding firm schedules and firm deadlines as to remaining pre-trial issues. The Court specifically discussed this goal with the parties. The parties advised the Court that a substantial and significant amount of the overall discovery in this matter has been completed and has been accomplished over the course of time that this matter has been pending before the Court. The parties are actively finishing up discovery and depositions as related to any possible further class certification motions and expect to be fully completed with this process in the next several weeks. The parties will submit to the Court, no later than 8/17/2019, a Joint proposal for a firm and final deadline to complete such discovery and such proposal will include a firm deadline of sometime within the first several weeks into September of 2019. TEXT Minute Entry for proceedings held before Magistrate Judge David E. Peebles: Telephone Conference held on 6/17/2019. Plaintiff's request for leave to file a renewed motion for class certification is pending before MAD. Defendant believes the motion is premature, while plaintiff argues that there is no reason to not move the case forward. Judge Peebles advised the parties that he would not usurp Judge D'Agostino's role, but suspected that she was waiting to address the request for leave until she knew the outcome of this conference. Discovery is not yet complete with written discovery demands having been served on 2/14/2019 and plaintiff responding to those demands in April. Defendant has served three third-party subpoenas and anticipates serving four more. Once responses are received, expert liability report may need supplementation. Plaintiff's deposition has not been noticed, but is expected to be held in July. Defendant requests an additional 90 days for discovery. Judge Peebles told the parties that class certification discovery must be completed by 8/16/2019 and that is a firm date. No new conference is set before Magistrate Judge Peebles, and advised that, in all likelihood, the matter would be reassigned to Judge Lovric. Settlement remains unlikely at this time. APP: Attys.
