Filing 43 MEMORANDUM-DECISION AND ORDER granting in part and denying in part 27 Motion for Summary Judgment: The Court hereby ORDERS that the claims brought on behalf of Plaintiff A.L. are DISMISSED in their entirety; and the Court further ORDERS that Def endants' Motion for Summary Judgment is GRANTED as to all claims against Defendants RODNEY V. MARSH and the CITY OF NORWICH, NEW YORK; and the Court further ORDERS that Defendants' Motion for Summary Judgment is GRANTED as to the neglige nce claim against Defendants BRANDON CLARKE and THOMAS MILLER; and the Court further ORDERS that Defendants' Motion for Summary Judgment is DENIED as to the excessive force and assault and battery claims against Defendant BRANDON CLARKE and the failure to intervene claim against Defendant THOMAS MILLER; and the Court further ORDERS that Defendants' Motion for Summary Judgment is DENIED as to Plaintiffs' request for punitive damages against Defendants BRANDON CLARKE and THOMAS MILLER; and the Court further ORDERS that the Clerk of the Court serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
