Filing 8 BANKRUPTCY RECORD ON APPEAL (Attachments: #1 Certificate of Non-Compliance)(usbcns, ) |
Filing 7 TEXT ORDER granting in part and denying in part #6 Appellants' motion for a Certificate of Appealability. To the extent the motion is made by Pratap Reddy, that motion is denied because the Notice of Appeal filed on 12/04/2019 (Dkt. No. #1 ) was never signed by Pratap Reddy (only Deepika Reddy), and non-attorneys cannot represent other persons in federal court. To the extent the motion is made by Deepika Reddy and arises from any ruling other than U.S. Bankruptcy Judge Diane Davis ruling of 11/25/2019 (i.e., denying Appellants' motion for relief from judgment), that portion of Deepika Reddy's motion is also denied as redundant (given Appellants' other pending appeal), untimely and/or unsupported by a showing of cause. The only portion of Deepika Reddy's motion that (albeit barely) satisfies the requirement of 28 U.S.C. 158(d)(2) (A) is the portion that arises from Bankruptcy Judge Davis' ruling of 11/25/2019, which (again albeit barely) satisfies 28 U.S.C. 158(d)(2)(A) (iii). Finally, Appellants are respectfully advised that their papers appear to have been drafted through the assistance of counsel: if that is the case, then their claim to be proceeding "pro se" is specious (and any conduct of such counsel in drafting such a claim is misleading and thus improper). (See, e.g., Dkt. No. #6 , at 1, 13-14.). According to the docket sheet, Deepika Reddy filed a #3 notice of change of address reflecting a temporary address in India from December 23, 2019 through February 19, 2020. In light of these circumstances, any motion for reconsideration an/or appeal of this text order is due to be filed on or before March 4, 2020, which is fourteen days after the date of return of the appellant to the United States. SO ORDERED by Chief Judge Glenn T. Suddaby on 1/3/2020. (Copy served upon appellants via regular mail at Fayetteville, NY address). |
