April 8, 2024 Filing 34 TEXT ORDER: Plaintiff Motion to Amend #31 is DENIED, without prejudice. The current operative complaint is Amended Complaint #14 . Fed. R. Civ. P. 15(a)(1) permits a party to amend its pleading once as a matter of course within 21 days after serving it or 21 days after a responsive pleading has been filed. Plaintiff has already amended its complaint once as a matter of course pursuant to Fed. R. Civ. P. 15(a)(1). See Dkt. No. 14. Motion to amend #31 is not in compliance with N.D.N.Y. L.R. 15.1 and N.D.N.Y. L.R. 7.1, in that, it fails to provide a memorandum of law, a supporting affidavit, proof of service on all Defendants, and an unsigned copy of the proposed amended pleading. Motion to amend #31 is also not in compliance with N.D.N.Y. L.R. 15.1, in that, it fails to set forth specifically the proposed insertions and deletions of language and identify the amendments in the proposed pleading, either through the submission of a redline/strikeout version of the pleading sought to be amended or through other equivalent means. See N.D.N.Y. L.R. 15.1 & 7.1. Plaintiff is also cautioned that any amended pleading will replace the existing complaint, and must be a wholly integrated and complete pleading that does not rely upon or incorporate by reference any pleading or document previously filed with the Court. See, Shields v. Citytrust Bancorp, Inc., 25 F.3d 1124, 1128 (2d Cir. 1994)(It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect.). Plaintiff is advised, for a second time now, to comply with the Fed. R. Civ. P. and the N.D.N.Y. Local Rules. See Text Order Dkt. No. 20.
