MEMORANDUM DECISION & ORDER granting in part and denying in part Defendant's # 34 Motion for Partial Summary Judgment; and it is further ORDERED that counsel are directed to appear on APRIL 16, 2010 at 2:30 p.m. in chambers for a pretrial conf erence, at which counsel are directed to appear with settlement authority, and in the event that the case does not settle, trial will be scheduled at that time.
