MEMORANDUM-DECISION & ORDER denying # 23 Defendant's Motion for Summary Judgment; and denying # 26 Plaintiff's Cross-Motion for Summary Judgment. Signed by Judge Glenn T. Suddaby on 8/23/13. Counsel are directed to appear on SEPTEMBER 30, 2013 at 2:00 p.m. in chambers for a pretrial conference, at which counsel are directed to appear with settlement authority, and in the event that the case does not settle, trial will be scheduled at that time. Plaintiff is further directed to forwa rd a written settlement demand to defendants no later than SEPTEMBER 13, 2013, and the parties are directed to engage in meaningful settlement negotiations prior to the 9/30/13 conference. In the event that counsel feel settlement is unlikely, counsel may request to participate via telephone conference for the limited purpose of scheduling a trial date by electronically filing a letter request at least one week prior to the scheduled conference.
