No. 15) is GRANTED; and the Court further ORDERS that Plaintiff's request for attorneys' fees is DENIED; and the Court further ORDERS that, because the Cour t lacks subject matter jurisdiction over this matter, Defendant's motion to dismiss for failure to state a claim (Dkt. No. 3) is DENIED without prejudice; and the Court further ORDERS that the Clerk of the Court shall transfer this case to the N ew York State Supreme Court, Onondaga County; and the Court furtherORDERS that the Clerk of the Court shall close this case upon transfer to the New York State Supreme Court, Onondaga County; and the Court furtherORDERS that the Clerk of the Court shall serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
