Filing 42 MEMORANDUM-DECISION AND ORDER granting 34 Motion for Summary Judgment; granting in part 39 Motion to deem the entire statement of material facts as admitted; granting in part 40 Motion to Preclude Plaintiff's expert's report and aff idavit: The Court hereby ORDERS that Defendants' motion for summary judgment (Dkt. No. 34) is GRANTED; and the Court further ORDERS that Defendants' motion to deem the entire statement of material facts as admitted (Dkt. No. 39) is GRANTE D in part as discussed herein; and the Court further ORDERS that Defendants' motion to preclude Plaintiff's expert's report and affidavit (Dkt. No. 40) is GRANTED in part as discussed herein; and the Court further ORDERS that the Cl erk of the Court shall enter judgment in Defendants' favor and close this case; and the Court further ORDERS that the Clerk of the Court shall serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
