May 27, 2020 Opinion or Order TEXT NOTICE SCHEDULING a Settlement Conference to be held on 6/25/20 at 1:00 PM before Magistrate Judge David E. Peebles to be held by Skype-For-Business. Judge Peebles will make arrangements for the conference. In preparation for the scheduled settlement conference, not later than 6/18/20, the parties shall submit a short, concise statement setting forth the material facts of the case, together with an indication of which if any are disputed; providing a synopsis of the parties' respective legal positions concerning any issues presented in the case; and outlining any settlement discussions which have occurred. The parties should also identify all the participants' names, e-mail addresses and phone numbers where they can be reached. November 4, 2019 Opinion or Order Filing 68 TEXT ORDER: Letter Motion #67 is GRANTED. Dunton Letter and Affidavits shall be forwarded to the Clerk of Court by 11/18/2019. Furthermore, the Court has recently altered its Dunton filing procedures and therefore advises and directs as follows. DUNTON TEXT ORDER: The Court is aware that the defendants are jointly represented in this case by the same counsel. In addition to counsels ethical obligation to inform each client of the potential adverse consequences of joint representation, this court has a continuing obligation to supervise the bar and assure litigants a fair trial. See Dunton v. County of Suffolk, State of N.Y., 729 F.2d 903, 908-09 (2d Cir. 1984). Accordingly, it is my duty to ensure that each defendant in this action represented by counsel fully appreciates the potential inherent conflict in joint representation of multiple defendants and understands the potential threat a conflict may pose to each defendants interests. Id. at 909. ACCORDINGLY, it is ORDERED that: (1) If it has not already been accomplished, counsel for defendants shall send a letter to OR have a detailed conversation with each of their individual clients in this action (a) outlining the circumstances under which an actual or potential conflict of interest may arise, including but not limited to those implicated by Canons 5 and 9 of The Lawyer's Code of Professional Responsibility, as adopted by the Northern District of New York (L.R. 83.4(j)), and (b) advising whether counsel plans to take a position adverse to that client's interests at trial; (2) after being informed of the potential or actual conflict, (a) if any client wishes to retain separate counsel, they will be given leave to promptly and expeditiously do so, in which case new counsel shall submit a Notice of Appearance to this Court, or (b) alternatively, in the event that any individual client wishes to proceed while being represented by current counsel, I will require additional assurance that the client has made an informed decision to do so, notwithstanding the potential for conflict, which must be in the form of a sworn affidavit from the client FILED UNDER SEAL (i) acknowledging that he or she has been given written or detailed oral notice by counsel of the potential for conflict, (ii) acknowledging that he or she understands the potential conflict and its ramifications, and (iii) stating that he or she has knowingly and voluntarily chosen to proceed with joint representation; and (3) a client/party who consents to joint representation will not be deemed to have waived his or her right to retain separate counsel.
