Filing 12 TEXT ORDER: granting #10 motion for leave to proceed IFP for purposes of filing and for consideration of this court's #5 Order and Report-Recommendation. Plaintiff's original IFP motion #2 was insufficient. The court ordered plaintiff to properly complete and resubmit such motion. Plaintiff has done so, and the court finds that he is financially eligible to proceed IFP. This court reviewed the merits of plaintiff's original complaint in the Order and Report-Recommendation #5 , which is pending before Judge Sharpe.
