No. 2) is GRANTED; RECOMMENDED that Plaintiffs complaint (Dkt. No. 1) be DISMISSED WITH LEAVE TO AMEND against Defendants Syracuse Police Chief Fowler and the City of Syracuse on initial review under 28 U.S.C. 1915(e), except that Chief Fowler remain listed as a Defendant solely for service and discovery purposes with regard to the Doe Defendants until such time as the District Court orders otherwise; and it is further RECOMMENDED that Plaintiffs 1983 Fourth Amendment false arrest and conspiracy claims against Defendants Heard, and John Does #1-3, and Jane Doe #4 SURVIVE initial review and require a response.
