December 23, 2019 Opinion or Order Filing 63 TEXT ORDER denying #58 Plaintiff's Cross-Motion to Amend and #61 his Motion for a Temporary Restraining Order as procedurally improper (for the reasons stated above in Dkt. No. 28 and in the Text Notice filed on 11/26/2019) and as barred by the law-of-the-case doctrine (given the Court's rulings in Dkt. Nos. 28 and 35 ), and directing him to SHOW CAUSE in writing, within FOURTEEN (14) DAYS of the date of this Text Order, why he should not be BARRED from making any future filings in this action pro se, and thus why this action should not be DISMISSED without prejudice, until he proceeds through counsel in this action, due to his vexatious litigation conduct in this action thus far. That vexatious conduct includes, but is not limited to, the following: (1) ignoring the Court's directive to provide to the Court summonses for issuance by the Court (see Dkt. Nos. 21 , 29 , 41 , #60 ); (2) repeatedly mislabeling motions as returnable before U.S. District Judge Brenda K. Sannes (see Dkt. Nos. #23 , #24 , #25 , #30 , #31 , #32 , #33 , #37 ) despite the fact that he knows, or reasonably should know, that on October 31, 2019, the case was reassigned to the undersigned (Dkt. No. 9 ), causing confusion to Court staff; (3) repeatedly filing procedurally improperly motions without a memorandum of law and affidavit (see Dkt. Nos. #23 , #24 , #25 , #33 , #42 , #43 , #44 , #45 , #58 , and #61 ), despite the fact that he knows, or reasonably should know, of that procedural impropriety (given Dkt. No. 28 , the Text Notice filed on 11/26/2019, and his receipt of a courtesy copy of Local Rule 7.1 and pages 35 and 36 of the District's Pro Se Handbook on Nov. 6, 2019, see Dkt. No. #22 ), wasting the precious resources of the Court, which has a congested docket; and (4) filing motions that he knows, or reasonably should know, to be without cause given the Court's prior rulings (as referenced above). The Court notes that on 11/26/2019 it specifically cautioned that, "if he continues to file such abusive and/or vexatious motions in this action, he will be ordered to show cause why he should not be barred from proceeding without counsel in this action." (Text Notice filed 11/26/2019.) Yet, his vexatious conduct has continued. (Dkt. Nos. #58 and #61 .) Under the circumstances, the Court finds Plaintiff's conduct to be vexatious and unnecessarily burdensome to the Court, Plaintiff's motive to be lacking in good faith, and other sanctions to be inadequate to protect the Court and Plaintiffs opposing parties. Nos. #37 , #38 , #42 , #43 , #44 , #45 ) which are all denied at this time for the following reasons. Dkt. No. #37 seeks to "refute the testimony provided by Demedre R. Heulett" which presumably refers to the Heulett affidavit at Dkt. No. #11 submitted in support of Defendant The Bureau of National Affairs' ("Defendant") original motion to dismiss at Dkt. No. #10 .
