March 9, 2020 Opinion or Order Filing 24 ORDER : The Non-Debtor Defendant's time to submit an answer or other responsive pleading to the Underlying Complaint pending in this Court is extended for a period of seven (7) days following the hearing on the PI Motion (currently scheduled for March 24, 2020) and entry of an order by the Delaware Bankruptcy Court with respect to the PI Motion (the "Del. Bankr. Ct. PI Order"). Upon entry of the Del. Bankr. Ct. PI Order, the Non-Debtor Defendant's deadline to answer or otherwise respond to the Underlying Complaint in this Court will be extended until August 17, 2020 (180 days from the commencement of the BSA's chapter 11 case), or such date as may be otherwise ordered or extended by order of the Delaware Bankruptcy Court. The Non-Debtor Defendant shall promptly notify this Court of the entry of the Del. Bankr. Ct. PI Order and any modification or extension thereof. March 9, 2020 Opinion or Order Filing 23 TEXT ORDER granting #8 Defendant Longhouse Council Inc.'s Letter-Motion for the reasons stated therein. The opposition of Defendant Weedsport Central School District (Dkt. No. #11 ) is unpersuasive because, regardless of whether the Court grants the Letter-Motion (which was not filed on behalf of Defendant Boy Scouts of America, a party that is entitled to an automatic stay), the Court may decide Defendant Weedsport Central School District's motion to dismiss for failure to state a claim. Moreover, Plaintiff does not object to the relief requested in the Letter-Motion. (Dkt. No. #17 .) After carefully considering the matter the Court finds that that any disadvantage to Plaintiff is outweighed by the necessity to preserve both the resources of the Court and the integrity of the Debtor Boy Scouts of America's estate. The Court finds that the automatic stay provisions of 11 U.S.C. 362(a) do not apply to Plaintiff's claims against Defendant School District (a non-debtor), because the disposition of those claims would not appear to have an immediate adverse economic consequence on Defendant Boy Scouts of America's estate. See Queenie, Ltd. V. Nygard Intl, 321 F.3d 282, 287 (2d Cir. 2003) ("The automatic stay can apply to non-debtors, but normally does so only when a claim against the non-debtor will have an immediate adverse economic consequence for the debtor's estate.").
