ORDER and REPORT AND RECOMMENDATIONS re Dkt. #1 Complaint, Dkt. #2 MOTION for Leave to Proceed in forma pauperis and Dkt. #3 MOTION to Appoint Counsel: it is ORDERED that Plaintiffs application to proceed in forma pauperis (Dkt. No. #2 ) is DENIED WITHOUT PREJUDICE; and it is further ORDERED that the Clerk of the Court shall provide Plaintiff with a blank in forma pauperis application (AO 240); and it is further ORDERED that Plaintiffs motion for appointment of counsel (Dkt. No. #3 ) is DENIED; and it is further respectfully RECOMMENDED that the Court DISMISS WITHOUT PREJUDICE and WITHOUT LEAVE TO AMEND Plaintiffs Complaint (Dkt. No. #1 ) pursuant to 28 U.S.C. 1915(e)(2)(B) for failure to state a claim upon which relief may be granted and because the Court lacks subject matter jurisdiction. Pursuant to 28 U.S.C. 636(b)(1), the parties have fourteen days within which to file written objections to the foregoing report. Such objections shall be filed with the Clerk of the Court. FAILURE TO OBJECT TO THIS REPORT WITHIN FOURTEENDAYS WILL PRECLUDE APPELLATE REVIEW. ( Objections to R&R due by 7/11/2022, Case Review Deadline 7/14/2022).
